Opening a Branch in Turkey

Based on the authority it receives from the center, the branch operates in the fields of activity of the center. However, the branch does business on its own.

Branch openings are also considered as "foreign direct investment" within the framework of the Foreign Direct Investment Law No. 4875.

Therefore, foreign companies with their headquarters abroad can continue their activities with the "opening of a branch" procedure without establishing a separate company in Turkey.

In this context, in accordance with the relevant provisions of the Turkish Commercial Code No. 6102, companies residing in a foreign country wishing to open branches in Turkey can be registered as domestic commercial enterprises.

The procedures and requirements regarding branch opening transactions and the information and documents that may be requested may vary within the scope of each trade registry directorate in practice.

Branch openings are extremely important both from a legal and tax point of view, and it is extremely important that the procedures are carried out according to the current situation.
